MISLEADING AND COMPARATIVE ADVERTISING IN CONSUMER RELATIONSHIPS

ABSTRACT

Misleading and comparative advertising, in fact like other unfair consumer practices, has become increasingly diverse in recent years, including with the application of information technology. But the countermeasures have also become more effective, largely due to the aspirations of European integration and the signing of the Association Agreement of the Republic of Moldova with the European Union (Association Agreement of 27.06.2014). These important processes have brought significant results, and finding that consumer protection in the field of misleading and comparative advertising in the Republic of Moldova was regulated below European standards, and essential regulations to ensure consumer interests were lacking, efforts were made to significantly improve legislation. Through a broad process of harmonizing it with European Union legislation. The most significant regulations in the field of misleading and comparative advertising can be found both in the national legislation, such as the Law on Advertising no. 1227 of 27.06.1997, the Law on Consumer Protection no. 105 of 13.03.2003 and the Competition Law no. 183 of 11.07.2012, as well as in the legislation of the European Union, the Directive of the European Parliament and of the Council on misleading and comparative advertising no. 2006 / 114 / EEC of 12.12.2006. An essential role in regulating misleading and comparative advertising is also represented by the adoption of Law no. 133 of 15 November 2018 on the modernization of the Civil Code and the amendment of some legislative acts, which entered into force on March 1, 2019. The aim of the study is to analyze both national regulations and European Union legislation, as well as unfair practices used by economic agents in misleading and comparative advertising.

ABSTRACT

In the context of the development of the energy sector, the prioritization of energy efficiency has become a basic principle in the context of the future evolution of the Energy Union. This principle aims to bring Europe to the forefront of climate policy and to meeting the goals of the transition to clean energy, set out in the Paris Agreement. In this context, the European Union supports energy development assistance projects in all its Member States, including projects implemented in the Eastern Partnership countries. The overall objective is to support sectorial policies to reform energy sector by ensuring the supply of electricity, streamlining the energy sector, and reducing the effects of carbon dioxide by harnessing renewable energy sources. To achieve these goals, the European Commission supports local, European, and global initiatives that provide viable solutions to protect the environment. Offering new opportunities to finance energy projects and responding to the needs of private investors to unlock their investments in support of green energy, the success of European energy efficiency policy remains to be guaranteed.

The importance of health status for the financial sustainability of the pension system. A case study of Romania in the context of the EU

ABSTRACT

Based on the need for a prosperous economy, it is important to increase the quality of life of the activepopulation in particular, but also of the inactive, in order to reduce the consumption of free and/orreimbursed medicines. In this regard, social security and protection systems need to consider
improving working conditions, expanding the network of medical services, creating medical, social and professional recovery systems, continuously improving the material and medical situation of people, in order to increase the time of productive activity. This study aims to analyse the evolution
of pension categories in Romania for the period 1990-2018, as well as the correlation between health and financial sustainability of the pension system, with an emphasis on healthy life expectancy. In order to develop the case study, the authors consider the evolution of this system in the last decade in Romania, following the average number of people retiring early, as well as people receivingdisability pensions

Public health service in the Republic of Moldova: from independence to the present

The Moldovan health care system has undergone significant reform since the country declared independence from the Soviet Union in 1991, although the health reform program was delayed for a number of years owing to the severe financial difficulties faced as Moldova embarked on political, economic, and social transition. However, despite the limited resource base, real progress has been made in rationalizing the health care system and reducing the dominance of inpatient care through the restructuring of hospital stock; stabilizing health care financing through the successful introduction of mandatory social health insurance, which was also successful in reducing the level of informal payments in the system; and developing primary health care based on family medicine. Thus, to walk towards a future where health is one of the main objectives to achieve and maintain it is empirical to know the past, mainly the way public health services evolved in the Republic of Moldova from the declaration of independence.

Analiza istorică a răspunderii juridice pentru încălcarea drepturilor pacienților

ABSTRACT

Viața și sănătatea omului sunt сonsiderate unanim сele mai de preț valori pentru omenire, în general, dar și pentru individ, în particular, сare, evident, neсesită pe deplin protejate. Pe arena internațională, prin Deсlarația Universală a Drepturilor Omului din 1948 și Сonstituțiile diferitor state, inсlusiv Republiсa Moldova, a fost reсunosсut dreptul omului la sănătate, сeea сe presupune dreptul oamenilor la sănătate și la serviсiile de îngrijire mediсală. În prezentul articol autorii abordează tematica evoluției răspunderii juridice a prestatorilor de servicii medicale pentru încălcarea drepturilor pacienților.

Considerații științifice cu privire subiecții sistemului de ocrotire a sănătății

ABSTRACT

În prezent, cea mai mare parte din cheltuielile financiare pentru servicii medicale sunt acoperite de către consumatori şi companiile de asigurare. Libertatea alegerii instituţiei medicale, apariţia noilor prestatori privaţi de servicii medicale şi diversificarea spectrului de servicii stimulează concurenţa pe piaţa serviciilor medicale şi dezvoltarea strategiilor de marketing în domeniu. Necesitatea atragerii noilor pacienţi şi formarea unui cerc de clienţi fidelizaţi instituţiei medicale determină un interes major pentru strategiile de comunicare marketing. Creşterea numărului de instituţii medicale private a determinat o cerere sporită pentru calitatea înaltă a serviciilor medicale acordate. Pacienţii ,,de ieri” s-au transformat în consumatorii ,,de astăzi” cu cerinţe faţă de actul medical şi calitatea acestuia.

Energia din surse regenerabile: o importanță majoră pentru consumatorul european

ABSTRACT

Dezvoltarea Uniunii Energetice, în contextul dezvoltării durabile a societății europene, are ca obiectiv „o energie curată pentru toți europenii”, lucru dificil de realizat. Procesul de tranziție către o energie curată întâmpină multe dificultăți, deoarece unele state nu au o viziune paneuropeană cu privire la modul de eficientizare a procesului energetic. Pentru a asigura o stabilitate energetică și o dezvoltare continuă în domeniu, statele trebuie să găsească un compromis, în care să delimiteze interesele naționale de interesele sociale europene. Din acest punct de vedere, Guvernele tind să armonizeze legislația națională în conformitate cu standardele europene. De asemenea, acestea urmăresc să implementeze, la nivel național, Strategii Europene în materie de energie cu scopul de a liberaliza piața energetică, de a promova obținerea energiei din surse regenerabile, de a atrage investiții pentru a produce energia fără emisii și de a scade cu 43%, până în 2030, emisiile de dioxid de carbon generate de economia Uniunii Europene.

Guaranteeing consumer rights in online commerce

Protecting consumer rights has always been a global goal. The pandemic accentuated the importance and topicality of the researched subject, because during this period most purchases take place online, and consumers must know their rights. The scope is to inform citizens about their rights as consumers in the online environment, whether they buy from local or international sites. Following the research, we came to the conclusion that although each state has its own legislation, international treaties are applied and any consumer problem can be solved, it is important that the consumer is informed and defends his interests.
